March Hearing Dates Set for Kamikamica and Prasad Applications

TThe Suva High Court has set new hearing dates for Member of Parliament and former Deputy Prime Minister, Mr. Manoa Kamikamica, which will coincide with the matter involving fellow Member of Parliament and former Deputy Prime Minister, Professor Biman Prasad.
The matters relate to separate applications by Mr. Kamikamica and Professor Prasad seeking a permanent stay of the criminal proceedings against them in the Magistrates Court for charges laid by the Fiji Independent Commission Against Corruption (FICAC).
Both matters were called today before Justice Siainiu Fa’alogo-Bull, as they raise similar issues concerning the appointment of FICAC Acting Commissioner, Ms. Lavi Rokoika, and the validity of the charges.
Justice Bull clarified that the matters were listed together today solely for case management purposes and confirmed that the cases have not been consolidated. Mr. Kamikamica’s matter was listed for mention, as a trial date had already been set for 25 March 2026.
Counsel for Mr. Kamikamica, Mr. Wylie Clarke, informed the court that the same King’s Counsel will appear in both matters.
He further advised that confirmation had been received from the Judicial Services Commission (JSC) stating that it had no role in the appointment of Ms. Rokoika as Acting Commissioner of FICAC.
Mr Clarke said the JSC’s response will be filed by way of a supplementary affidavit, for which they sought leave to be filed in court today.
Mr. Clarke also indicated that two subpoenas would be filed in relation to news articles containing comments made to the media by Prime Minister Sitiveni Rabuka and Ms. Rokoika regarding her appointment.
FICAC State Counsel, Ms. Josann Pene, submitted that the material could be addressed in the applicant’s affidavit.
Justice Bull said she would rule on the issue on 5 February 2026.
In Professor Prasad’s matter, counsel Mr. Ashish Nand informed the court that a report had also been received from the JSC regarding Ms. Rokoika’s appointment, and similar to the Kamikamica matter, a supplementary affidavit based on the JSC’s letter is also intended to be filed and served today subject to leave from the Court.
The Court accordingly granted leave for both applications.
FICAC State Counsel, Mr. Joseph Work, sought time to respond, which was granted, with 7 days allowed for filing a response.
Justice Bull set the hearing date for Mr. Kamikamica’s application for 18 March 2026, while Professor Prasad’s application will be heard on 19 March 2026.
The matters will be heard back-to-back, with 20 March 2026 reserved for any spillover.
Both matters have been adjourned to 5 February 2026 for mention, with a focus on the calling of witnesses for the hearings.
