High Court Dismisses Application by Former iTLTB Officer
Posted by Media Team 05 October 2026
The High Court in Suva has dismissed an application by former iTaukei Lands Trust Board (iTLTB) employee, Mr Josaia Waqairatu seeking to have his convictions for two counts of Bribery quashed and a fresh trial ordered.
The judgment was delivered today, by Justice Dane Tuiqereqere.
Mr Waqairatu had been convicted of two counts of Bribery by the Suva Magistrates Court on 28 August 2026 and was awaiting sentencing.
In his application, Mr Waqairatu argued that his trial was not conducted in accordance with Section 139 of the Criminal Procedure Act 2009 following the transfer of the Resident Magistrate who presided over his trial.
The High Court found that the magistrate who conducted the trial remained seized of the matter, heard the evidence and closing submissions, and ultimately determined Mr Waqairatu’s guilt.
The Court therefore dismissed the application and made no order as to costs.
The Fiji Independent Commission Against Corruption (FICAC) was the respondent in the proceedings.
